Methodology for conducting a competition for filling a vacant position in the state civil service, the procedure and terms of work of competition commissions in the customs authorities of the Russian Federation

I. General provisions

1. This Methodology for conducting a competition for filling a vacant position in the civil service, the procedure and terms for the work of competition commissions in the customs authorities of the Russian Federation (hereinafter referred to as the Methodology) determines the rules for the work of competition commissions, the organization and procedure for holding a competition for filling a vacant position in the civil service in customs authorities of the Russian Federation.
2. The main objectives of holding a competition for filling a vacant position in the state civil service in the customs authorities of the Russian Federation (hereinafter referred to as the competition) are:
ensuring the constitutional right of citizens of the Russian Federation to equal access to the state civil service (hereinafter referred to as the civil service);
ensuring the right of civil servants of the customs authorities (hereinafter - civil servants) to promotion on a competition basis;
formation of a personnel reserve of the customs authority to fill civil service positions;
selection and formation on a competitive basis of highly professional personnel;
improvement of work on the selection and placement of personnel.
3. The competition is to evaluate professional level candidates for a vacant civil service position, their compliance with the qualification requirements for this position.

II. Organization of the competition in the customs authorities

4. Competition in the customs authority to fill a vacant position in the civil service, the recruitment of which in accordance with Article 22 of the Federal Law of July 27, 2004 No. 79-FZ "On the State Civil Service of the Russian Federation" (Collected Legislation of the Russian Federation, 2004, No. 3215; 2006, No. 6, art. 636) (hereinafter referred to as the Federal Law) can be produced on a competitive basis, is announced by decision of the head of the customs authority or his deputy, who is the chairman of the competitive commission, no later than three days from the day the vacancy opens, about which the appropriate order of the customs authority is issued. The competition is not held:
a) upon appointment to positions of the state civil service of the Russian Federation (hereinafter referred to as civil service positions) of the categories “heads” and “assistants (advisors)” to be replaced for a certain period of office;
b) upon appointment to civil service positions of the category "leaders", the appointment and dismissal of which are carried out by the President of the Russian Federation or the Government of the Russian Federation;
c) when concluding a fixed-term service contract;
d) when appointing a civil servant to another position of the civil service in case of impossibility of execution official duties on the position to be replaced for health reasons in accordance with the medical report; when reorganizing, liquidating, changing the structure of the customs authority, reducing the position of the civil service in the event that a civil servant, taking into account his qualifications, professional education and length of service in the civil service or work (service) in his specialty, is provided with the opportunity to replace another civil service position in the same or another customs authority , in the case of sending a civil servant to professional retraining or professional development;
e) upon appointment to the position of the civil service of a civil servant (citizen) who is in personnel reserve formed on a competitive basis.
The competition may not be held in the following cases:
a) upon appointment to certain positions of the civil service, the performance of official duties for which is associated with the use of information constituting a state secret, according to the list of positions approved by the decree of the President of the Russian Federation;
b) upon appointment to civil service positions related to the group of junior civil service positions.
Citizens of the Russian Federation who have reached the age of 18, speak the state language of the Russian Federation and meet the qualification requirements for a vacant civil service position established by the legislation of the Russian Federation on the civil service have the right to participate in the competition.
5. The competition is held in two stages.
At the first stage, the customs authority publishes an announcement on the acceptance of documents for participation in the competition in official periodicals bodies state power of the subject of the Russian Federation and other periodicals of the subject of the Russian Federation on whose territory it is located, posts information on its own website in the public information and telecommunication network (if such is available in the customs authority). The announcement of the competition is posted on information stand at the customs office. The published announcement of the competition must contain information on the full name of the vacant civil service position, the requirements for the applicant for filling this position, the place and time of receipt of documents to be submitted, the deadlines for accepting documents, as well as information about the source detailed information about the competition (telephone, fax, Email, legal address, e-mail address of the website of the customs authority). Responsible for organizing the placement of information about the competition is the chairman of the competition commission.
The following information about the competition is posted on the website of the customs authority in the public information and telecommunications network:
the name of the vacant position of the civil service of the customs authority;
requirements for the applicant for this position, the conditions for the civil service;
the list, as well as the place and time of receipt of documents to be submitted for participation in the competition;
the period until the expiration of which the said documents are accepted;
the expected date of the competition, the place and procedure for its holding;
other information materials necessary for participation in the competition.
6. A citizen of the Russian Federation who has expressed a desire to participate in the competition shall submit the following documents to the personnel department of the customs authority:
a) a personal application, which is registered in the register of participants in the competition (Appendix No. 1 to the Methodology) (the secretary of the competition commission is responsible for maintaining such a register, as well as for receiving and registering applications);
b) a self-filled and signed questionnaire in the form established by the order of the Government of the Russian Federation dated May 26, 2005 No. 667-r “On approval of the form of the questionnaire for participation in the competition for filling a vacant position in the civil service of the Russian Federation” (Collected Legislation of the Russian Federation, 2005 , No. 22, item 2192), with a photo attached;
c) a copy of the passport or a document replacing it (the relevant document is presented in person upon arrival at the competition);
d) documents confirming the required professional education, work experience and qualifications:
copy work book(except for cases when service (labor) activity is carried out for the first time) or other documents confirming the labor (service) activity of a citizen (copies of employment orders, certificates from the previous place of work, and others); copies of documents about vocational education, as well as at the request of a citizen - on additional professional education, on awarding an academic degree, academic title, certified by a notary or personnel services at the place of work (service);
e) a document confirming that the citizen does not have a disease that prevents entry into the civil service or its passage;
f) other documents stipulated by the Federal Law, other federal laws, decrees of the President of the Russian Federation and resolutions of the Government of the Russian Federation.
After the citizen submits all the documents necessary for participation in the competition, the personnel division of the customs authority organizes verification of the accuracy of the information contained in the documents.
7. A civil servant who has expressed a desire to participate in the competition sends an application addressed to the head of the customs authority in which the competition is held. This application is registered in the register of participants in the tender. The personnel unit of the customs authority, in which a civil servant fills a position, ensures that he receives all required documents to participate in the competition.
Verification of the accuracy of the information provided by a civil servant is carried out only if he participates in the competition for filling a vacant civil service position belonging to the highest group of civil service positions.
8. All documents required for participation in the competition must be submitted to the personnel department of the customs authority within 30 days from the date of the announcement of their acceptance. Based on the submitted documents, the competition commission decides on the admission of candidates to participate in the competition.
Untimely submission of documents, their submission not in full or in violation of the rules for registration without good reason are grounds for refusing to accept a citizen. If there is a good reason, the head of the customs authority or the chairman of the tender commission has the right to postpone the deadlines for their acceptance.
9. With the consent of a citizen (civil servant), a procedure is carried out for obtaining his access to information constituting state and other secrets protected by law, if the performance of official duties in a vacant position for which a competition is being held is associated with the use of such information.
If a citizen (civil servant) refuses to carry out the procedure for issuing access to information constituting a state and other secret protected by law, if the performance of official duties in the position of the civil service, for which the competition is being held, is associated with the use of such information, he is not allowed to participate in competition.
10. A citizen (civil servant), by decision of the competition commission, is not allowed to participate in the competition due to his inconsistency with the qualification requirements for the vacant position for which the competition is held, as well as in connection with the restrictions established by the legislation of the Russian Federation on the state civil service for admission to the civil service and its passage, of which he is notified in writing with an explanation of the reasons for making such a decision or under the signature in the register of participants in the competition in the column "Note on familiarization with the results of the competition." The notification is drawn up in a free form with the assignment of a registration number and signed by the chairman of the competition committee. The date and registration number of the notification are also entered in the register of participants in the tender.
11. An applicant for filling a vacant position in the civil service in the customs authorities, who is not allowed to participate in the competition, has the right to appeal this decision in accordance with the legislation of the Russian Federation.
12. The decision on the date, place and time of the second stage of the competition is made by the chairman of the competition commission of the customs authority after verifying the accuracy of the information submitted by citizens to fill a vacant position in the civil service, if there are at least two candidates, and also after obtaining, if necessary, access to information constituting state and other secrets protected by law.
Not later than 15 days before the start of the second stage of the competition, the secretary of the competition commission of the customs authority in which the competition is held informs citizens (civil servants) admitted to participate in the competition (hereinafter referred to as candidates) about the date, place, time and conditions of its holding under the signature. Notification can be carried out both in writing and under the signature in the register of participants in the competition.
13. If, as a result of the competition, no candidates were identified who meet the qualification requirements for the vacant position of the civil service, for which he was announced, the head of the customs authority or the deputy head of the customs authority, who is the chairman of the competition commission, may decide to conduct a repeated competition.

III. Creation of a tender commission in the customs authorities, the procedure and terms of its work

14. The competition commission is collegiate body, which is formed in each customs body of the Russian Federation for organizing and holding competitions.
15. The competition commission consists of a chairman, deputy chairman, secretary and members of the commission. The members of the commission include the most qualified representatives of the personnel and legal divisions customs authority, as well as the unit in which a competition is held to fill a vacant position.
The composition of the tender commission is formed for a period determined by the head of the customs authority. The number of members of the tender committee, including independent experts, must be at least 5 people.
The composition of the tender committee is formed in such a way that the possibility of a conflict of interest that could affect the decisions made by the tender committee is excluded.
The chairman of the tender commission is one of the deputy heads of the customs body, determined by the head of the customs body. The chairman of the competition commission manages the activities of the competition commission, and is also responsible for organizing the holding of competitions in the customs authority. During the period of temporary absence of the chairman of the competition commission (illness, business trip, being on vacation, etc.), the leadership of the competition commission is carried out by the deputy chairman of the competition commission.
To ensure the work of the competition commission (registration and acceptance of applications, formation of cases, keeping a register of participants in the competition, keeping minutes of the meeting of the commission, etc.), the secretary of the competition commission is appointed ( executive personnel department of the customs authority). The secretary of the competition commission does not participate in the evaluation of candidates and does not have the right to vote when making decisions by the competition commission.
After the establishment in accordance with the established procedure of the federal state body for the management public service representatives of these bodies are also included in the competitive commission of the customs body.
Representatives of scientific and educational institutions. These experts are invited by the relevant civil service management body at the request of the customs authority (prior to the establishment of such a body, experts are invited directly by the customs authority itself), while the request indicates only the professional specifics and the necessary specialization that experts must possess. The number of independent experts must be at least one quarter of the total number of members of the tender committee.
The composition of the competition commission for holding a competition for filling a vacant position in the civil service, the performance of official duties for which is associated with the use of information constituting a state secret, is formed taking into account the provisions of the legislation of the Russian Federation on state secrets.
The procedure and terms of the activity of the tender commission are determined by the regulations of the work of the tender commission of the customs authority.
The composition of the tender commission, as well as the regulations for its work, are approved by order of the customs authority.
It is allowed to form several competitive commissions in the customs body for various categories and groups of positions in the civil service or in the areas of activity of the units of the customs authority, in the structure of which there is a vacant position in the civil service, for which a competition is being held.
16. A meeting of the tender commission of the customs authority shall be considered competent if at least two thirds of the total number of its members are present at it.
17. During the competition, the competition commission evaluates candidates on the basis of the documents submitted by them.
It is also allowed to conduct an individual interview and other competitive procedures using non-contradictory federal laws and other regulatory legal acts of the Russian Federation methods for assessing professional and personal qualities candidates (questionnaires, group discussions, testing on issues related to the performance of official duties for the position for which the candidates are applying). The form of questioning and testing, the number and content of questions in them, as well as the topic of the group discussion are established by the competitive commission of the customs authority, depending on the duties assigned to the position for which the competition is being held.
18. When evaluating the professional and personal qualities of candidates, the competition commission proceeds from the relevant qualification requirements to a vacant position for which a competition is being held, and other provisions of the official regulations related to the performance of duties in this position, as well as other provisions established by the legislation of the Russian Federation on the civil service.
19. Candidates are evaluated on a 10-point system. Based on the results of the assessment, each member of the competition commission gives the candidate an appropriate score, which is entered in the competition bulletin (Appendix No. 2 to the Methodology) with a brief motivation that served as the basis for making a decision on the appropriate assessment. The tender bulletin is attached to the minutes of the meeting of the tender commission.
After evaluating all the participants of the competition and counting their points, the competition commission determines the winner of the competition. The candidate with the most points is considered the winner of the competition.
In case of equality of points for several candidates, the decision of the competition commission is made by open voting by a simple majority of votes of its members present at the meeting. When voting, the opinion of the members of the commission is expressed in the words “for” or “against”. In case of equality of votes, the vote of the chairman of the competition commission is decisive. The decision is made in the absence of the candidate and is the basis for his appointment to a civil service position in the customs authority or refusal to do so.
The results of voting and the decision of the competition commission are recorded in the minutes of the meeting, which is signed by all members of the commission who were present at the meeting. The minutes of the meeting of the competition commission are kept by the secretary of the competition commission in free form.

IV. Final provisions

20. According to the results of the competition, no later than two weeks after it is held, an order of the customs authority is issued to appoint the winner of the competition to the vacant position of the civil service, which was filled this contest, and a service contract is concluded with him on the passage of the state civil service of the Russian Federation and the replacement of the position of the state civil service of the Russian Federation.
21. Candidates who participated in the competition are notified of the results of the competition in writing within a month from the date of its completion or against signature in the register of participants in the competition. The notification is drawn up in a free form with the assignment of a registration number and signed by the chairman of the competition committee. The date and registration number of the notification are entered in the register of participants in the competition.
Information on the results of the competition is also posted on the website in the public information and telecommunications network (if such is available in the customs authority) and posted on the information stand in the premises of the customs authority.
22. At the request of the persons participating in the competition, they are issued an extract from the minutes of the meeting of the competition commission.
23. The documents of the participants in the competition may be returned to them upon a written application addressed to the head of the customs authority within three years from the date of completion of the competition. Until the expiration of this period, the applicants' documents and the minutes of the meetings of the tender commission are stored in the archives of the customs authority, after which they are subject to destruction. The transfer of the above documents to the archive is carried out in accordance with the procedure for transferring documents for storage to the archive established by the customs authorities.
24. Expenses associated with holding competitions for filling vacant positions in the civil service in the customs authorities are made within the funds provided for the maintenance of customs authorities. The remuneration of independent experts is carried out in accordance with the Decree of the Government of the Russian Federation dated August 12, 2005 No. 509 “On the procedure for remuneration of independent experts included in the composition of the attestation and competitive commissions, as well as the commission for compliance with the requirements for official conduct of federal state civil servants and settlement conflicts of interest generated by federal government bodies”(Collection of Legislation of the Russian Federation, 2005, No. 34, Art. 3503).
25. Expenses associated with the participation of candidates in the competition (travel to the place of the competition and back, renting accommodation, accommodation, use of communication services, etc.) are covered by them at the expense of own funds.
26. The decision of the competition commission may be appealed by the candidate in accordance with the legislation of the Russian Federation.
