Decree 822. The procedure for providing medical care to minors, including during the period of training and education in educational organizations - Rossiyskaya Gazeta

federal law dated November 21, 2011 N 323-FZ "On the basics of protecting the health of citizens in Russian Federation"(Collected Legislation of the Russian Federation, 2011, N 48, Art. 6724; 2012, N 26, Art. 3442, 3446; 2013, N 27, Art. 3459, 3477; N 30, Art. 4038) I order:

1. This procedure establishes the rules for the provision medical care minors, including during the period of education and upbringing in educational organizations.

3. Minors, including during the period of education and upbringing in educational institutions, are guaranteed the provision of medical care in accordance with the procedures for the provision of medical care, as well as on the basis of standards of medical care within the framework of the program of state guarantees of free provision of medical care to citizens, in the form of:

Organization of health care for minors during the period of education and upbringing (with the exception of the provision of primary health care, medical examinations and prophylactic medical examinations) in organizations carrying out educational activities is carried out by these organizations.

The organization of the provision of primary health care to minors during the period of education and upbringing, their passage of medical examinations and medical examinations, is carried out by the executive authorities in the field of healthcare. The educational organization is obliged to provide free of charge medical organization premises that meet the conditions and requirements for the implementation of medical activities.

5. Primary health care for minors under the age of 18 studying in educational institutions implementing basic educational programs (hereinafter referred to as students), in order to provide them with primary health care in an emergency and emergency form, including in case of sudden acute diseases, conditions, exacerbation of chronic diseases, as well as disease prevention, is provided in the department of organization of medical care for minors in educational organizations (hereinafter referred to as the department of medical care for students).

6. In the absence of a department of medical care for students, primary health care in accordance with this Procedure may be provided in offices, health centers of a medical organization or other legal entity carrying out, along with the main (statutory) activities medical activity.

7. In the structure of the medical care department, students are provided with a medical unit, which is located in the premises of the educational organization.

9. The premises provided by the educational organization must comply with the established sanitary and epidemiological norms and rules and the established requirements for the implementation of medical activities.

10. In the event that the educational organization does not provide premises with appropriate conditions for the work of medical workers or the medical organization does not have a license for certain works (services), at the location of the premises of the educational organization, it is allowed to provide medical care to minors, during their training and education, in the premises of the medical organization .

13. Primary health care for students is provided by pediatricians, hygienists for children and adolescents, paramedics and nurses of the medical care department for students.

14. Primary health care for students in need of treatment, rehabilitation and recreational activities is provided by pediatricians, hygienists for children and adolescents, specialist doctors, paramedics and nurses of the department for organizing medical care for students.

15. Additional views and the volume of medical care for students, the provision of medical care on other conditions than provided for by this Procedure, is organized and carried out by an educational organization in compliance with the requirements of the Russian Federation in the field of health protection.

17. If there are indications, pediatricians, medical specialists, paramedics of the medical care department send the minor to the medical organization for the medical care of which the minor is.

18. A prerequisite for medical intervention is the giving of informed voluntary consent of a minor or other legal representative to medical intervention in compliance with the requirements established by the Federal Law of November 21, 2011 N 323-FZ "On the basics of protecting the health of citizens in the Russian Federation" (hereinafter - Federal Law N 323-FZ).

19. When organizing medical examinations (screenings) of minors, during the period of training and education in educational organizations, and providing them with primary health care in a planned form, the educational organization assists in informing minors or their parents (legal representatives) in the preparation of informed voluntary consent to medical intervention or their refusal of medical intervention in relation to certain types medical intervention.

20. When providing medical assistance to a minor for emergency reasons to eliminate the threat to life without the consent of parents (legal representatives), in accordance with the Federal Law, medical worker informs his parents (legal representatives) about the medical care provided.

1. This Regulation establishes the procedure for organizing the activities of the department for organizing medical care for minors in educational organizations (hereinafter referred to as the department for medical care for students).

2. The department of organization of medical care for students is structural unit a medical organization or other legal entity that, along with its main (statutory) activities, carries out medical activities and provides medical care to minors under the age of 18 studying in educational organizations implementing basic educational programs (hereinafter referred to as students).

3. The purpose of the department of medical care for students is to provide students with primary health care in an emergency form and urgent form, including in case of sudden acute diseases, conditions, exacerbation of chronic diseases, as well as disease prevention.

4. For the position of head of the medical care department, students are assigned a medical worker who meets the Qualification requirements for specialists with higher and postgraduate medical and pharmaceutical education in the field of healthcare, approved by order of the Ministry of Health and social development of the Russian Federation of July 7, 2009 N 415n (registered by the Ministry of Justice of the Russian Federation on July 9, 2009, registration N 14292) as amended by the order of the Ministry of Health and Social Development of Russia of December 26, 2011 N 1644n (registered by the Ministry of Justice of the Russian Federation on April 18, 2012 , registration N 23879) (hereinafter - Qualifications to specialists with higher and postgraduate medical and pharmaceutical education in the field of healthcare), in the specialty "pediatrics", having at least 5 years of experience in this specialty, in accordance with the order of the Ministry of Health and Social Development of the Russian Federation dated July 23, 2010 N 541н "On the approval of the One qualification handbook positions of managers, specialists and employees, section " Qualification characteristics positions of workers in the healthcare sector" (registered by the Ministry of Justice of the Russian Federation on August 25, 2010, registration N 18247).

7. In the structure of the medical care department, students are provided with a medical unit, which is located on the premises of an educational organization and consists of a pediatrician's (paramedic's) office and a treatment room.

1. These Rules establish the procedure for submitting project documentation for objects, construction, reconstruction, overhaul of which is supposed to be carried out on the lands of specially protected natural areas of federal, regional and local significance, for the state examination of project documentation (hereinafter referred to as the urban planning examination) and the state environmental examination of the project documentation (hereinafter - environmental impact assessment) in cases where construction, reconstruction, overhaul of facilities on these lands are allowed by the legislation of the Russian Federation and the legislation of the constituent entities of the Russian Federation.

2. Project documentation is submitted by the applicants (customers, developers or persons authorized by any of them) for urban planning and environmental expertise to the authorized executive authorities directly or sent by mail with a list of attachments.

3. The composition, content and design of sections of project documentation must comply with the requirements, established by law of the Russian Federation on urban development and environmental expertise, including the Regulation on the composition of sections of project documentation and requirements for their content, approved by Decree of the Government of the Russian Federation of February 16, 2008 N 87, and the Regulation on the procedure for conducting state environmental expertise, approved by resolution Government of the Russian Federation dated June 11, 1996 N 698.

4. Design documentation for urban planning expertise and environmental expertise is submitted:

A) to the Ministry of Construction and Housing and Communal Services of the Russian Federation - in relation to facilities, construction, reconstruction, overhaul of which is supposed to be carried out on the lands of specially protected natural areas of federal significance, and especially dangerous, technically complex and unique facilities, construction, reconstruction, overhaul the repair of which is supposed to be carried out on the lands of specially protected natural territories of regional and local significance, with the exception of objects, the town-planning expertise of which is attributed in accordance with the decrees of the President of the Russian Federation to the powers of other federal bodies executive power; (As amended by the Decree of the Government of the Russian Federation of March 26, 2014 N 230)

B) to the Ministry of Defense of the Russian Federation, Federal Service protection of the Russian Federation and the Federal Security Service of the Russian Federation - in relation to the facilities specified in subparagraphs "a" and "c" of this paragraph, which are objects of the military infrastructure of the Armed Forces of the Russian Federation, and other objects of defense and security that are under the jurisdiction of these federal bodies executive power and town-planning expertise of which is assigned in accordance with the decrees of the President of the Russian Federation to the powers of these bodies;

C) to the executive authority of the constituent entity of the Russian Federation authorized to conduct state examination of project documentation - in relation to objects, the construction, reconstruction, overhaul of which is supposed to be carried out on the lands of specially protected natural areas of regional and local significance, with the exception of the objects specified in subparagraphs "a" and "b" of this paragraph.

5. The Ministry of Construction and Housing and Communal Services of the Russian Federation, within 3 working days from the date of receipt of the project documentation, sends it:

A) to the Federal Service for Supervision of Natural Resources to conduct an environmental review; (As amended by the Decree of the Government of the Russian Federation of February 15, 2011 N 78)

B) in government agency, authorized to conduct state examination of project documentation, subordinated to the Ministry of Construction and Housing and Communal Services of the Russian Federation, to conduct urban planning examination. 6. The Ministry of Defense of the Russian Federation, the Federal Security Service of the Russian Federation and the Federal Security Service of the Russian Federation, within 3 working days from the date of receipt of the project documentation, send it for environmental impact assessment:

A) to the Federal Service for Supervision of Natural Resources - in relation to the objects specified in subparagraph 71 of Article 11 of the Federal Law "On Environmental Expertise"; (As amended by the Decree of the Government of the Russian Federation of February 15, 2011 N 78)

B) to the executive authority of a constituent entity of the Russian Federation authorized to conduct a state environmental review of project documentation - in relation to the facilities specified in subparagraph 41 of Article 12 of the Federal Law "On Environmental Review".

7. The executive authority of the subject of the Russian Federation, authorized to conduct a state examination of project documentation, within 3 days from the date of receipt of the project documentation sends it:

A) to the executive authority of the subject of the Russian Federation, authorized to conduct a state environmental review of project documentation, to conduct an environmental review;

B) to a state institution subordinate to it, authorized to conduct a state examination of project documentation, to conduct an urban planning examination (if such an institution exists).
