Public holidays

Long holiday weekend (3 days or more)

In total, the Government of the Russian Federation has planned 5 long weekends for this year (with 3 or more weekends in a row). Shortened pre-holiday days

Legislative provisions

According to article 91 of the Labor Code of the Russian Federation, the norm cannot exceed 40 hours per week. In cases where the employer, following the law, must establish a reduced work time approved 24, 35 or 36 hours a week.

The PB rate is necessary for the establishment, as well as for payment, on weekends and holidays.

RV standards

The following time standards are distinguished:

  • Work week. It can consist of five days (Saturday and Sunday are weekends), or six, but its duration should normally be 40 hours, or with an abbreviated PB - 24, 35 or 36.
  • Change. The concept of a work shift includes the time after which the workers employed in one labor process, replace each other. It can be day and night. At shift work sometimes there is such a nuance as the inability to reduce the duration of the shift when it is provided (for example, on a pre-holiday day). Then this time is considered processing and is paid in accordance with the norms overtime work or compensated by the provision. Payment night shift(from 22.00 to 06.00) occurs in an increased amount, which is approved by the employer.
  • Working day. The time during the day during which the work is done. Equal to normal 8 hours.
  • Accounting period. Time worked for a calendar period (for example, a quarter or a month, but not more than a year). This period allows the watch to be correlated with statutory standards. This is a kind of control over the RV norm.
  • Employment limit. Employment limit, statutory... An example would be. The number of hours worked in this case cannot exceed half of the RV norm per month. With a 40-hour work week in October 2019, part-time jobs should not take more than 84 hours.

Accounting for RV is selected in accordance with the specifics of the enterprise.

Rules and examples for calculating working hours

The calculation of working hours takes into account a large number of factors, but the main one is the work schedule. It can be daily, weekly and summarized. The latter assumes a shift schedule.

In addition, when accounting for radioactive substances, the following are provided:

  • view working week: five-day, six-day;
  • daily duration of work;
  • the time when the work was started and finished;
  • breaks;
  • sequence of working days with non-working days;
  • number of shifts in 24 hours;
  • the presence of holidays when the length of the working day is reduced.

Calculation per month

In general, the calculation of RV for a month with a five-day period is made according to the following formula:

Ntot = Prv: 5 x Krd - 1 h. X Kppd, where:

  • Ntot is the norm of RV;
  • Prv - duration of RV per week (40,35, 36 or 24);
  • Кр - the number of working days in the period (month, year);
  • Kppd - the number of days before the holidays.

For instance:

There are 21 working days in October 2019. So, with a 40-hour week, we get: 40: 5 x 21 - 0 = 168 hours. At 36 hours: 36: 5 (days) x 21 = 151.2 hours. Hence the conclusion is this: the maximum working time in October 2019 should not exceed 168 hours.

Six days

A six-day week also cannot exceed 40 hours in total.

Let's take the same October with a six-day period. There will be 26 working days, the norm is 168 hours. We divide 168 by 26, which makes about 6 and a half hours a day. But in the Russian Federation, a 7-hour RT duration is used for a six-day working week, and before the weekend it is reduced to 5 hours.

On the eve of the holiday, with a five-day working day, the working day is reduced by one hour, and a six-day working day cannot be more than five hours.

Number of working days between dates (formula)

Excel has a function like NETWORKDAYS. Its arguments are start and end dates. These are required values. And also an optional argument - holidays. When entering data on holidays, these days are excluded from the calculation.

RV calculation for 2019

The production calendar is taken as a basis. Here you need to take into account that the year is a leap year, and there are 366 days in it. There are 247 working days. Weekends and holidays - 119. There are only two pre-holiday days this year.

Calculating using the formula (if a 40-hour work week is taken), it turns out: 8 * 366 - 2 = 1974 hours.

If we take into account a week of 36 hours, then 1776.4 hours per year will turn out. And with a 24-hour week, respectively, 1183.6 hours of RT.

Calculation with shift schedule

With this kind of schedule is often used.

Summarized accounting is used when shift schedules, sliding weekend and approval.

The need for such accounting arises in cases where the required rate, for example, 40 hours per week, is not met. But it is for a certain accounting period - it can be 1 month (which is more convenient), quarter or year - it is leveled.

Example:

Driver Yu.P. Ivanov, who works at LLC Petra, where summarized accounting was introduced, and the quarter is taken for the calculation, worked 447 hours from January to March 2019 inclusive.

Of them:

  • 118 hours in January;
  • 145 hours in February;
  • 184 hours in March.

This driver is an employee with a 40-hour work week. This means that the norm for the first quarter is 447 hours, where:

  • 120 hours - January;
  • 159 hours - February;
  • 168 hours - March.

The calculations show that the norm was not exceeded.

RV calculation on a business trip

The traveler carries out a service assignment, and not his own, certain labor contract function.

In accordance with this, the time spent by the employee in is not the working time defined in Article 91 of the Labor Code.

The duration of RT in this case is set based on some factors:

  • the nature of the job assignment;
  • conditions of performance;
  • operating mode of the receiving side.

When involved in a business trip on weekends or holidays, these days must be affixed and paid accordingly.

Calculation of RV with a schedule after three days

Such a schedule refers to either shift work or flexible work. In this case, the norm of 40 hours per week cannot be met. Therefore, hours in excess of the norm will be considered overtime, and their number will be determined at the end of the accounting period.

Here it is more convenient to choose a period for accounting equal to one year. Then the processing will be compensated for by the flaw.

Partial bet settlement

For a normal working week (40 hours), the calculation is as follows:

  • If 0.75 rate is taken into account, then 40 * 0.75 = 30 hours per week. With five days, we divide 30 by 5, it turns out that the daily rate is 6 hours. To calculate the number of hours per month, you need 30: 5 * (the number of working days in calendar month). For example, there are 20 business days in February 2019. Hence, 30: 5 * 20 = 120 hours.
  • 0.25 rate: 40 * 0.25 = 10 hours. It should be borne in mind that working hours can be distributed as 5 days for 2 hours, and 2 days for 5 hours. Next, we also take February: 10 divided by 5 and multiplied by 20. That makes 40 hours a month.

Production calendar 2018 with holidays and weekends

All non-working holidays are listed in the Labor Code. These include (Article 112 of the Labor Code of the Russian Federation):

  • New Year - January 1-6 and 8,
  • Christmas - January 7,
  • Defender of the Fatherland Day - February 23,
  • International Women's Day - March 8,
  • Spring and Labor Day - May 1,
  • Victory Day - May 9,
  • Day of Russia - June 12,
  • Day national unity- November 4th.

All these dates are reflected in the 2018 calendar with holidays... According to the rules of the same Article 112 of the Labor Code, a holiday that coincides with a weekend is "shifted" to the working day immediately following the holiday. In 2018, such a day is Sunday 4 November, which means that Monday 5 November will also be non-working.

But there is an exception to this rule, which is valid for the New Year's "holidays": the days from January 1 to January 8, coinciding with the weekend, can be transferred to other days of the year, as a rule, they are added to other holidays, thereby "lengthening" them and changing the calendar of working days. For example, in 2017, due to January 1 and 7, which coincided with the weekend, the February and May holidays increased by 1 day (Decree of the Government of the Russian Federation of 08/04/2016 No. 756).

What transfers are offered in 2018? At the suggestion of the Ministry of Labor, a resolution of the Government of the Russian Federation of 10/14/2017 No. 1250 was prepared, according to which the production calendar for 2018 contains the following days off:

  • New Year and Christmas "holidays" will last from December 30, 2017 to January 8, 2018,
  • "Holidays" days off from January 6 and 7 are postponed to March 9 and May 2, respectively,
  • rest from Saturdays April 28, June 9 and December 29, 2018 was proposed to be postponed to the working days of April 30, June 11 and December 31, 2018, so as not to split the "long" weekend.

If the Government adopts this version of the resolution, then this is how everyone who works on the "five-day" holiday will rest. For those working on a six-day week, they will remain working days on March 9, April 30, June 11 and December 31, since the transfer of weekends to these dates is planned from Saturdays that coincide with non-working holidays, and for the “six days” Saturday is not a day off.

The working time is calculated according to the schedule of a five-day working week with days off Saturday and Sunday, based on the duration of daily work or shift (order of the Ministry of Health and Social Development of the Russian Federation of 13.08.2009 No. 588n). This calculation procedure is also used for the "six-day".

For the "five-day" week, the timesheet-calendar for 2018 indicates the following annual working hours:

  • with a 40-hour week (8 hours a day) - 1970 hours,
  • at 36 hours (7.2 hours a day) - 1772.4 hours,
  • at 24-hour (4.8 hours per day) - 1179.6 hours.

The duration of work before the holidays, according to the report card-calendar 2018, is reduced by an hour on February 22, March 7 and May 8. Also, working hours are reduced by 1 hour on working Saturdays on April 28, June 9 and December 29, due to which the rest has been postponed to Mondays.

The standard working time for any month is calculated as follows: the number of hours of the working week must be divided by 5, multiplied by the working days of the "five-day" in a particular month, and subtract the hours by which work is reduced on pre-holiday days.

For example: the production calendar-2018 in June shows 20 working days, incl. 1 pre-holiday (June 9). Working hours in June with a 40-hour week will be 159 hours (40 hours: 5 days x 20 days - 1 hour).

The total number of working days on the "five-day" in 2018 - 247, of which the pre-holiday "shortened" - 6, weekends with holidays - 118.

Working hours for a "six-day" in 2018, similar to a five-day week, cannot exceed 40 hours per week (Article 91 of the Labor Code of the Russian Federation).

Reduction of pre-holiday working days by an hour, for those working six days a week, is provided for February 22, March 7, April 30, May 8, June 11, November 3, December 31.

Working days for a six-day week would be 299 days, and non-working days would be 66 days.

Traditionally, weekends and holidays are marked on the calendar with a color other than working days, usually red. Pre-holiday days, when the work should be finished 1 hour earlier, are marked with an "asterisk".

Annual challenge

From obtaining a kitchen stool to creating a jet plane, any product or product is produced anyway with the participation of a person.

A group of specialists, a large team or an individual master in their sector of activity spend a certain amount of time on work. Therefore, when planning production processes and mutual cooperation with other companies and buyers of manufactured products, the manufacturer must calculate in advance the working hours for each specialty involved in his enterprise. Ultimately, this also affects the number of employees who can be accepted into the organization.

In short, the management, together with the personnel department and standard setters, have to calculate the NRV every year.

How to determine the annual rate

Let's first reveal the term itself. By general rule working time rate is the number of hours spent doing work in a calendar period. Usually. They take 40 hours a week as a basis.

Today, it is calculated on the basis of the order that is set out in the order of the Ministry of Health and Social Development of the Russian Federation of August 13, 2009 No. 588n (hereinafter also referred to as the Procedure).

According to the provisions of this normative act, the duration of the working week (at a rate of 40 working hours, and sometimes less) is divided by 5 (if a person works on a 5-day schedule) and multiplied by the number of working days per year. After that, the number of hours by which the working days that go right before the official public holidays are subtracted from the result:

  • New Year;
  • May 9;
  • other similar holiday dates.

According to the law, a working day and at the same time a pre-holiday day is usually considered reduced by 1 working hour.

The working hours for the next year must be calculated before the end of the previous year. In this case, you need to take into account:

  1. Labor legislation requirements of the Russian Federation.
  2. Resolutions of the Government of the Russian Federation, correcting working days and holidays for the next year.

So, regarding the period of 2017, the Cabinet of Ministers of the Russian Federation issued a decree of August 4, 2016 No. 756. It says that such rest days will be postponed:

  • 01.01.2017 to 24.02.2017;
  • 01/07/2017 to 05/08/2017.

It is possible that for a beginner in the field of labor rationing, these procedures will seem confusing and difficult to understand. However, only taking into account all these decrees and by-laws can it be found out how the norm of working hours for 2017 and subsequent working periods is correctly calculated.

Working hours in 2017

When determining it, one should take into account the following provisions:

  • even if the employee works 5 or 6 days a week, Sunday is considered a day off;
  • it is possible to postpone the day off for individual specialists only if the enterprise, for objective reason, is not able to stop the work process for the weekend. That is, the staff must perform their duties both on Saturday and Sunday. This is stated in article 111 Labor Code;
  • in article 112 of the Labor Code of the Russian Federation there is a list of holidays at the onset of which workers have a rest.

The Labor Code also refers to the holidays as New Year's holidays (from 01.01 to 08.01 inclusive). Christmas is also classified as a holiday with a day off.

In addition, a holiday that falls on a weekend carries over such a day of rest. This principle works every year. The only exceptions are the first 8 days of January - New Year and Christmas. The fact is that the transfer of days of rest to the New Year holidays does not automatically occur. Every year the Government of the Russian Federation in separate order instead, it approves the days when employees of enterprises have a rest and do not go to work. This point is stipulated by part 5 of article 112 of the Labor Code of the Russian Federation.

According to the legislation (part 1 of article 95 of the Labor Code of the Russian Federation), the duration of the working day on the eve of an official holiday should be cut by 1 hour.

All of the above requirements of the Labor Code of the Russian Federation, as well as the accounting of the Procedure, are the basis for calculating working hours for a calendar year. Speaking specifically and in numbers, the norm of working hours for 2017 will be as follows:

Average monthly NRV for 2017

However, knowing the total annual labor time does not give a complete picture of the working hours in each month. Full accounting requires you to be aware of the average monthly working time (each month separately).

For these purposes, the number of calendar days in a month matters. It can be from 28 to 31. So, 2017 is not considered a leap year. In addition, each month has its own number of holidays and days off. And it differs significantly. For example, in January - as many as 8 days in addition to weekends were declared non-working. But April and October in 2017 have no non-working holidays at all.

Thus, you can use the average monthly working hours to plan your workflow. We need to put together all the data specific year and the duration of the working time in it, calculated in hours.

It is generally accepted that the average number of working hours per month is obtained by dividing the total annual amount of hours by 12. So, for employees with different working hours, the norm of working hours for 2017 is shown in the table.

Local features

The above figures apply to all Russian Federation... However, some regions may declare their own days of rest associated with local religious holidays. Namely - on the basis of Article 4 of the Law "On Freedom of Conscience and Religious Associations" dated September 26, 1997 No. 125-FZ.

There are also additional provisions that allow the authorities of the constituent entities of the Russian Federation to make certain calendar dates as days off for reasons other than religious ones. These are article 6 of the Labor Code and paragraph 8 of the letter of the Ministry of Labor of Russia dated June 10, 2003 No. 1139-21.

In such cases, the estimated norm of working hours for 2017 will look different than generally in Russia.

Local weekends have an essential feature. If they are introduced, then the region will compensate for all the losses in income for itself.

Employee category accounting

It is necessary to calculate the NRW taking into account the category of the specialist and the specifics of the work. So, in some moments the working time of the staff should be cut. Despite the fact that other employees of this enterprise working on the same schedule do not receive changes in their work schedule.

For instance:

  • Article 92 of the Labor Code says about the working time limit for employees with disabilities of the first two groups. A maximum of 35 hours per week they can be employed in the enterprise;
  • if there are jobs with hazardousness of the 3rd or 4th degree - no more than 36 working hours;
  • Article 94 of the Labor Code of the Russian Federation limits the working time of underage employees. Duration - no more than 7 hours a day. And if he is under 16, then the maximum is 5 hours at work.

Production calendar taking into account the norm of working hours for 2017

Often in factories or on the Internet, you can find a production calendar that takes into account all work shifts, holidays, weekends, working hours shifts, etc. (see the figure below). It should be noted that such a calendar stands somewhat apart from the Labor Code and Order, since it does not have official recognition. It cannot be considered a normative act.

However, in practical use, the calendar is very convenient, which is why it is often used. Accountants use it in calculating billable days (for example, by sick leave), and the HR department uses it to schedule employee vacations.

That is, a similar calendar is compiled independently on the basis of a regular calendar, where weekends and holidays are indicated.
