Story

Brothers Kondraty and Mikhail Shtaf founded a tobacco factory in Saratov in 1828. Initially, the factory was designed to meet the needs of the hussar regiment located in Saratov. In this regard, tobacco products were expensive and good quality... However, literally a few years later, the hussar regiment from Saratov was transferred and the factory had problems with sales. The expensive products of the factory were not in demand by the local population.

The problem was solved by using local raw materials. At the beginning of the 19th century, such an industry Agriculture how the cultivation of tobacco in the Volga region was absent. In fact, the founders of tobacco growing were the Staf brothers: from imported seeds a small area was originally planted with tobacco. Further competition leads to the fact that the Shtaf factory becomes unprofitable and is acquired by a competitor in 1915. From that moment on, Levkovich remains the only tobacco and tobacco product manufacturer in Saratov. His company united 2 factories: Shtafa and his own at the corner of Astrakhan and Tsyganskaya streets. The total number of workers at the enterprises of Levkovich reached 600 people, which, by the standards of that time, made the company one of the largest in the city (for example, the factories of the “flour kings” of the Schmidts had a comparable number of employees).

The Russian division of the world's largest cigarette manufacturer, the British American Tobacco Corporation (BAT), lost in the Arbitration Court of Appeal the first of a series of tax cases, the total claims on which by the Federal Tax Service of Russia are estimated at more than 335 million rubles. After the decision of the court, the BAT branch in Saratov will pay taxes, penalties and fines to the treasury in the amount of 69.4 million rubles. The tax authorities believe that the Russian division of the company unreasonably underestimated the tax base due to the costs of consulting, information and management services from the headquarters in London. BAT does not agree with these claims and says that such a scheme is a common international business practice.

On October 29, the 9th Arbitration Court of Appeal considered the appeal of the Federal Tax Service against the decision of the Moscow Arbitration Court, which in mid-August declared unfounded claims for loggers against British American Tobacco - STF, the Saratov factory of the BAT Russia group of companies. The tax authorities believed that the factory had inflated the price of the consulting services provided for it by the parent company, CJSC MUMT, and thus reduced the tax base. At the request of the Federal Tax Service, experts estimated the cost of services and confirmed the suspicions of the tax authorities. After several months of litigation, the Moscow Arbitration Court dismissed the tax authorities' first claim against British American Tobacco - STF OJSC, considering the expertise insufficiently convincing. The FTS did not give up and filed an appeal. Now the Court of Appeal has fully satisfied the claim of the Federal Tax Service against the tobacco factory.

Thus, British American Tobacco - STF must pay 69.4 million rubles to the treasury: taxes - 52 million rubles, penalties - 7.4 million rubles and a fine - 10 million.

In the near future, the courts will hear other claims of the Federal Tax Service against BAT Russia. Thus, the claim against the capital's BAT-Java factory for the recovery of 37.3 million rubles will be considered on November 5 in the court of first instance in Moscow. And on November 18, a hearing is scheduled at first instance in the case of the St. Petersburg branch of BAT-SPb on the collection of taxes for 245 million rubles.

In all cases, the Federal Tax Service's claims relate to payments that BAT's Russian branches regularly make to the headquarters in London for the provision of consulting, information and management services.

Representatives of the Russian division of the tobacco giant explained that, like any other international company, branches use the services of their central office and pay for these services.

We do not agree with the position of the tax authorities because it is common practice for most international companies to pay for consulting and management services at the headquarters, ”BAT told Izvestia. - It complies with the principles established by the Organization economic development and cooperation. There is nothing illegal and extraordinary about it.

The Federal Tax Service "Izvestia" did not comment on the course of the arbitration proceedings.

Meanwhile, BAT Russia is still a defendant in criminal cases of tax fraud initiated in May 2013 by the TFR in Moscow. The cases were initiated upon the fact, and there are no accused or suspects in them. In one case, we are talking about the St. Petersburg factory of ZAO BAT-SPb, which, according to the investigation, underpaid about 245 million rubles to the budget. In another - about the Saratov OJSC "BAT-STF", where the non-payment of almost 52 million rubles. Another case mentions the Moscow tobacco factory BAT-Java, which is charged with a tax debt of 37.3 million rubles. According to the investigation, all these companies underpaid taxes in the period 2008-2009.

Experts believe that the TFR can withdraw its claims against BAT.

If, according to the decision of the Arbitration Court, BAT pays the money, then the criminal cases will most likely be closed, because the damage caused will be compensated, - believes Konstantin Trapaidze, chairman of the bar association "Your legal attorney". - But if the IC finds corpus delicti in actions officials, business may resume.

Experts also do not exclude that the reason for the initiation of the case could be a mistake of the tax authorities.
