1. 2. 2. The federal state bodies and management bodies of state non-budgetary funds of the Russian Federation approve the requirements determined in accordance with these Rules for certain types of goods, works, services purchased by them, their territorial bodies and subordinate state and budgetary institutions, federal state unitary enterprises, including a list certain types goods, works, services, their consumer properties (including quality) and other characteristics (including marginal prices of goods, works, services) (hereinafter referred to as the departmental list). With regard to certain types of goods, works, services included in the mandatory list, their consumer properties (including quality) and other characteristics (including the marginal prices of these goods, works, services) are determined in the departmental list, if these properties and characteristics not included in the mandatory list.

Federal state bodies and management bodies of state off-budget funds of the Russian Federation in the departmental list determine the values ​​of the characteristics (properties) of certain types of goods, works, services (including the marginal prices of goods, works, services) included in the mandatory list, if in the mandatory list does not define the values ​​of such characteristics (properties) (including the marginal prices of goods, works, services).

3. Certain types of goods, works, services not included in the mandatory list are subject to inclusion in the departmental list, provided that the arithmetic mean sum of the values ​​of the following criteria exceeds 20 percent:

a) the share of payment for a particular type of goods, works, services to meet federal needs for the reporting financial year (in accordance with payment schedules) under contracts, information about which is included in the register of contracts concluded by customers and the register of contracts containing information constituting the state secrecy, a federal state body, a management body for state off-budget funds of the Russian Federation, their territorial bodies and state and budgetary institutions subordinate to them, federal state unitary enterprises in the total amount of payment under contracts included in these registers (according to payment schedules), concluded by the relevant federal state bodies, governing bodies of state extra-budgetary funds of the Russian Federation, their territorial bodies and state and budgetary institutions subordinate to them, federal state unitary enterprises; (as amended by Decrees of the Government of the Russian Federation of March 11, 2016 N 183, of November 30, 2016 N 1270)

4. Federal state bodies and management bodies of state off-budget funds of the Russian Federation, when included in the departmental list of certain types of goods, works, services not specified in the mandatory list, apply the criteria established by paragraph 3 of these Rules based on determining their values ​​as a percentage of the volume of ongoing federal state bodies, management bodies of state off-budget funds of the Russian Federation and their territorial bodies and state and budgetary institutions subordinate to them, federal state unitary procurement enterprises. 5. In order to form a departmental list, federal state bodies and management bodies of state non-budgetary funds of the Russian Federation have the right to determine additional criteria for the selection of certain types of goods, works, services and the procedure for their application that do not lead to a reduction in the value of the criteria established by paragraph 3 of these Rules.

6. When compiling a departmental list, federal state bodies and management bodies of state non-budgetary funds of the Russian Federation have the right to additionally include in it:

a) certain types of goods, works, services that are not included in the mandatory list and do not meet the criteria specified in paragraph 3 of these Rules;

b) characteristics (properties) of goods, works, services that are not included in the mandatory list and do not lead to unreasonable restrictions on the number of procurement participants;

c) values ​​of quantitative and (or) qualitative indicators of characteristics (properties) of goods, works, services that differ from the values ​​provided for by the mandatory list, and the justification for which is contained in the corresponding column of Appendix No. 1 to these Rules, including taking into account the functional purpose goods, which for the purposes of these Rules is understood as the purpose and conditions of use (application) of the goods, allowing the goods to fulfill their main purpose, auxiliary functions or determining the universality of the use of the goods (performance of relevant functions, works, provision of relevant services, territorial, climatic factors, etc.) .

7. The values ​​of consumer properties and other characteristics (including marginal prices) of certain types of goods, works, services included in the departmental list are established:

a) taking into account the categories and (or) groups of positions of employees of federal state bodies, management bodies of state extra-budgetary funds of the Russian Federation and their territorial bodies and state and budgetary institutions subordinate to them, federal state unitary enterprises, if the costs of their acquisition in accordance with the requirements for determination of standard costs for ensuring the functions of federal state bodies, management bodies of state off-budget funds of the Russian Federation, including state institutions subordinate to them, approved by Decree of the Government of the Russian Federation of October 20, 2014 N 1084 "On the procedure for determining the standard costs for ensuring the functions of federal state bodies, governing bodies of state extra-budgetary funds of the Russian Federation, including state institutions subordinate to them" (hereinafter referred to as the requirements for determining standard costs), are determined taking into account om categories and (or) groups of positions of employees; (as amended by Decree of the Government of the Russian Federation of November 30, 2016 N 1270)

b) taking into account the categories and (or) groups of positions of employees, if the costs of their acquisition in accordance with the requirements for determining the standard costs are not determined taking into account the categories and (or) groups of positions of employees, - if the appropriate decision is made by the federal state body, body management of the state off-budget fund of the Russian Federation.

8. Separate types of goods, works, services additionally included in the departmental list must differ from those indicated in the mandatory list of certain types of goods, works, services by the code of goods, works, services in accordance with the All-Russian Classifier of Products by Type economic activity.

8. The Ministry of Finance of the Russian Federation, in agreement with the Ministry of Telecom and Mass Communications of the Russian Federation, within 3 months from the date of receipt of the proposals provided for in subparagraph "c" of paragraph 7 of this resolution, submit to the Government of the Russian Federation a draft act on amendments to the General rules for determining requirements for certain types of goods, works, services purchased by customers (including marginal prices for goods, works, services), approved by Decree of the Government of the Russian Federation of September 2, 2015 N 926 "On Approval General rules determination of requirements for certain types of goods, works, services purchased by customers (including marginal prices for goods, works, services)”, concerning the general rules for determining requirements for software purchased by customers and (or) rights to it, services (works) for the development , installation, testing, maintenance, technical support, adaptations, modifications software, services (works) for the design, creation, modernization (refinement, development), maintenance, technical support of information systems.

GENERAL RULES

1. These General Rules establish the procedure for determining the requirements for certain types of goods, works, services purchased by customers (including the marginal prices of goods, works, services).
The State Corporation for Atomic Energy "Rosatom" and the State Corporation for Space Activities "Roscosmos" approve the requirements for certain types of goods, works, services purchased by them (including the marginal prices of goods, works, services) in the manner established by these General Rules.
For the purposes of these General Rules, the type of goods, works, services means the types of goods, works, services corresponding to the 6-digit position code according to the All-Russian Classifier of Products by Types of Economic Activity.

2. Government of the Russian Federation, supreme executive bodies state power of the constituent entities of the Russian Federation and local administrations establish the rules applied by state bodies, management bodies of state non-budgetary funds, municipal bodies, their territorial bodies and subordinate state and budgetary institutions for determining the requirements for certain types of goods, works, services purchased by them (including marginal prices for goods , works, services) to meet, respectively, federal needs, the needs of the constituent entities of the Russian Federation and municipal needs (hereinafter referred to as the rules for determining requirements).

3. Requirements for certain types of goods, works, services purchased by state bodies, management bodies of state extra-budgetary funds, municipal bodies, their territorial bodies (subdivisions) and subordinate state and budgetary institutions (including the marginal prices of goods, works, services) are approved state bodies, management bodies of state non-budgetary funds and municipal bodies in the form of a list of certain types of goods, works, services in respect of which consumer properties (including quality characteristics) and other characteristics that affect the price of certain types of goods, works, services are established (hereinafter referred to as the departmental list).

4. The rules for determining requirements provide for:
a) a mandatory list of certain types of goods, works, services, their consumer properties and other characteristics, as well as the values ​​of such properties and characteristics (including the marginal prices of goods, works, services) (hereinafter referred to as the mandatory list) and (or) the obligation of state bodies, governing bodies of state non-budgetary funds and municipal bodies to establish the values ​​of these properties and characteristics;
b) the procedure for the formation and maintenance by state bodies, management bodies of state extra-budgetary funds and municipal bodies of a departmental list, as well as approximate form departmental list;
c) the procedure for applying the mandatory criteria specified in paragraph 11 of these General Rules for the selection of certain types of goods, works, services, the meaning of these criteria, as well as additional criteria that are not defined by these General Rules and do not lead to a narrowing of the departmental list, and the procedure for their application.

5. The rules for determining requirements may provide for the following information, additionally included by state bodies, management bodies of state non-budgetary funds and municipal bodies in the departmental list:
a) certain types of goods, works, services not specified in the mandatory list;
b) characteristics of goods, works, services that are not included in the mandatory list and do not lead to unreasonable restrictions on the number of procurement participants;
c) values ​​of quantitative and (or) qualitative indicators of characteristics (properties) of goods, works, services that differ from the values ​​contained in the mandatory list, in cases provided for by the rules for determining requirements. At the same time, such values ​​must be justified, including using the functional purpose of the product, which for the purposes of these General Rules is understood as the purpose and conditions for the use (application) of the product, allowing the product to fulfill its main purpose, auxiliary functions or determining the universality of the application of the product (performance relevant functions, work, provision of relevant services, territorial, climatic factors, etc.);
d) other information relating to the procurement of goods, works, services not provided for by these General Rules.

6. Mandatory list and the departmental list are formed taking into account:
a) provisions technical regulations, standards and other provisions stipulated by the legislation of the Russian Federation, including the legislation of the Russian Federation on energy saving and on increasing energy efficiency and the legislation of the Russian Federation in the field of protection environment;
b) the provisions of Article 33 of the Federal Law "On the contract system in the field of procurement of goods, works, services to meet state and municipal needs";
c) the principle of ensuring competition, defined by Article 8 of the Federal Law "On the contract system in the field of procurement of goods, works, services to meet state and municipal needs."

7. The departmental list is formed taking into account the functional purpose of the goods and must contain one or more of the following characteristics in relation to each individual type of goods, works, services:
a) consumer properties (including quality and other characteristics);
b) other characteristics (properties) that are not consumer properties;
c) marginal prices of goods, works, services.

8. The departmental list approved by state bodies, management bodies of state non-budgetary funds and municipal bodies should allow ensuring state and municipal needs, but not lead to the purchase of goods, works, services that have excessive consumer properties (functional, ergonomic, aesthetic, technological, environmental properties, reliability and safety properties, the values ​​of which are not determined by their suitability for operation and consumption in order to provide state (municipal) ) services (performance of work) and the implementation of state (municipal) functions) or are luxury goods in accordance with the legislation of the Russian Federation.

9. The mandatory list is drawn up in the form according to the appendix and can be supplemented with information provided for by the rules for determining requirements.

10. Certain types of goods, works, services are included in the mandatory list in accordance with the mandatory criteria specified in paragraph 11 of these General Rules, and if additional criteria are established in accordance with subparagraph "c" of paragraph 4 of these General Rules - in accordance with such criteria. Mandatory lists contained in the rules for determining requirements approved by higher executive bodies state authorities of the constituent entities of the Russian Federation and local administrations, include certain types of goods, works, services, in respect of which the mandatory list contained in the rules for determining requirements approved by the Government of the Russian Federation establishes marginal prices and (or) values ​​of the characteristics (properties) of such goods, works, services.

11. Mandatory criteria for the selection of certain types of goods, works, services used in the formation of a departmental list are at the same time:
a) the share of expenses for the purchase of certain types of goods, works, services of state bodies, management bodies of state extra-budgetary funds, municipal bodies, their territorial bodies and state and budgetary institutions subordinate to them in the total amount of expenses of the relevant state bodies, management bodies of state extra-budgetary funds, municipal bodies, their territorial bodies and state and budgetary institutions subordinate to them for the purchase of goods, works, services;
b) the share of contracts for the purchase of certain types of goods, works, services of state bodies, management bodies of state non-budgetary funds, municipal bodies, their territorial bodies and state and budgetary institutions subordinate to them in the total number of contracts for the purchase of goods, works, services concluded by the relevant state bodies, management bodies of state non-budgetary funds, municipal bodies, their territorial bodies and state and budgetary institutions subordinate to them.

12. The values ​​of consumer properties (including quality) and other characteristics (properties) of certain types of goods, works, services used in the formation of the mandatory list are established in quantitative and (or) qualitative indicators indicating (if necessary) the unit of measurement in accordance with All-Russian classifier units of measure.
Quantitative and (or) qualitative indicators of characteristics (properties) of certain types of goods, works, services can be expressed as an exact value, a range of values ​​or a ban on the use of such characteristics (properties).

The marginal prices of goods, works, services are set in rubles in absolute monetary terms (with an accuracy of 2 decimal places).

13. Requirements for certain types of goods, works, services are determined taking into account the categories and (or) groups of positions of employees, if the costs of acquiring certain types of goods, works, services to ensure the functions of state bodies, management bodies of state extra-budgetary funds of the Russian Federation, state bodies subjects of the Russian Federation, management bodies of territorial state non-budgetary funds, municipal bodies (including, respectively, territorial bodies, state institutions subordinate to them) in accordance with the rules for determining standard costs, approved respectively by the Government of the Russian Federation, the highest executive bodies of state power of the constituent entities of the Russian Federation, local administrations, are established taking into account categories and (or) groups of positions of employees.
Requirements for certain types of goods, works, services purchased by state and municipal state and budgetary institutions are delimited by categories and (or) groups of positions of employees of these institutions according to the staffing table.

14. The price of a unit of goods, works, services planned for purchase cannot be higher than the marginal price of goods, works, services established in the departmental list.

15. The marginal prices of goods, works, services established by the Government of the Russian Federation, the highest executive bodies of state power of the constituent entities of the Russian Federation, local administrations, cannot exceed the marginal prices of goods, works, services established by these bodies when approving standard costs for ensuring the functions of state bodies , management bodies of state extra-budgetary funds of the Russian Federation, state bodies of constituent entities of the Russian Federation, management bodies of territorial state extra-budgetary funds, municipal bodies (including, respectively, territorial bodies, state institutions subordinate to them).

16. Values ​​of characteristics (properties) of certain types of goods, works, services (including marginal prices of goods, works, services) included in the mandatory list contained in the rules for determining requirements and purchased for managers State Corporation for atomic energy "Rosatom" and the State Corporation for Space Activities "Roskosmos" cannot exceed (if the upper limit value is set) or be lower (if the lower limit value is set) the values ​​of the characteristics (properties) of the respective individual types of goods, works, services ( including the marginal prices of goods, works, services) established by the rules for determining requirements approved by the Government of the Russian Federation for a state civil servant replacing the position of the head or deputy head of a federal agency, belonging to the highest group of civil service positions of the category "heads".

2. 3. 4. The rules for determining requirements provide for:

a) a mandatory list of certain types of goods, works, services, their consumer properties and other characteristics, as well as the values ​​​​of such properties and characteristics (including the marginal prices of goods, works, services) (hereinafter referred to as the mandatory list) and (or) the obligation of customers set the values ​​of the specified properties and characteristics;

5. The rules for determining requirements may provide for the following information, additionally included by customers in the departmental list:
Decree of the Government of the Russian Federation of July 18, 2019 N 921.

a) certain types of goods, works, services not specified in the mandatory list;

b) characteristics of goods, works, services that are not included in the mandatory list and do not lead to unreasonable restrictions on the number of procurement participants;

c) values ​​of quantitative and (or) qualitative indicators of characteristics (properties) of goods, works, services that differ from the values ​​contained in the mandatory list, in cases provided for by the rules for determining requirements. At the same time, such values ​​must be justified, including using the functional purpose of the product, which for the purposes of these General Rules is understood as the purpose and conditions for the use (application) of the product, allowing the product to fulfill its main purpose, auxiliary functions or determining the universality of the application of the product (performance relevant functions, work, provision of relevant services, territorial, climatic factors, etc.);

d) other information relating to the procurement of goods, works, services not provided for by these General Rules.

6. The mandatory list and the departmental list are formed taking into account:

a) provisions of technical regulations, standards and other provisions stipulated by the legislation of the Russian Federation, including the legislation of the Russian Federation on energy saving and energy efficiency improvement and the legislation of the Russian Federation in the field of environmental protection;

b) the provisions of Article 33 of the Federal Law "On the contract system in the field of procurement of goods, works, services to meet state and municipal needs";

c) the principle of ensuring competition, defined by Article 8 of the Federal Law "On the contract system in the field of procurement of goods, works, services to meet state and municipal needs" .

7. The departmental list is formed taking into account the functional purpose of the goods and must contain one or more of the following characteristics in relation to each individual type of goods, works, services:

a) consumer properties (including quality and other characteristics);

b) other characteristics (properties) that are not consumer properties;

c) marginal prices of goods, works, services.

8. The departmental list approved by customers should allow meeting state and municipal needs, but not lead to the purchase of goods, works, services that have excessive consumer properties (functional, ergonomic, aesthetic, technological, environmental properties, reliability and safety properties, the values ​​of which are not due to their suitability for operation and consumption in order to provide state (municipal) services (performance of work) and the implementation of state (municipal) functions) or are luxury goods in accordance with the legislation of the Russian Federation.

9. The mandatory list is drawn up in the form according to the appendix and can be supplemented with information provided for by the rules for determining requirements.

10. Certain types of goods, works, services are included in the mandatory lists contained in the rules for determining requirements approved by the highest executive bodies of state power of the constituent entities of the Russian Federation and local administrations, in accordance with the mandatory criteria specified in clause 11 of these General Rules, the values ​​of which are calculated based on from payments under contracts and from the number of contracts concluded in order to meet the needs of the relevant subject of the Russian Federation or municipality, and if additional criteria are established in accordance with subparagraph "c" of paragraph 4 of these General Rules - in accordance with such criteria. Mandatory lists contained in the rules for determining requirements include certain types of goods, works, services, in respect of which the mandatory list contained in the rules for determining requirements approved by the Government of the Russian Federation establishes marginal prices and (or) values ​​of the characteristics (properties) of such goods, works, services.

11. Mandatory criteria for the selection of certain types of goods, works, services used in the formation of a departmental list are at the same time:

a) the share of payment for a particular type of goods, works, services (in accordance with payment schedules) under contracts, information about which is included in the register of contracts concluded by customers, and the register of contracts containing information constituting state secrets, by customers, their territorial bodies and organizations subordinate to them, provided for in paragraph 2 of these General Rules, in the total amount of payment under contracts included in these registers (according to payment schedules), concluded by the relevant customers, their territorial bodies and organizations subordinate to them, provided for in paragraph 2 of these General Rules;

b) the share of contracts for the purchase of certain types of goods, works, services of customers, their territorial bodies and organizations subordinate to them, provided for in paragraph 2 of these General Rules, in the total number of contracts for the purchase of goods, works, services concluded by the relevant customers, their territorial bodies and organizations subordinate to them, provided for in paragraph 2 of these General Rules.

12. The values ​​of consumer properties (including quality) and other characteristics (properties) of certain types of goods, works, services used in the formation of the mandatory list are established in quantitative and (or) qualitative indicators indicating (if necessary) the unit of measurement in accordance with the All-Russian classifier of units of measurement.

Quantitative and (or) qualitative indicators of characteristics (properties) of certain types of goods, works, services can be expressed as an exact value, a range of values ​​or a ban on the use of such characteristics (properties).

The marginal prices of goods, works, services are set in rubles in absolute monetary terms (with an accuracy of 2 decimal places).

13. Requirements for certain types of goods, works, services are determined taking into account the categories and (or) groups of positions of employees, if the costs of acquiring certain types of goods, works, services to ensure the functions of state bodies, management bodies of state extra-budgetary funds of the Russian Federation, state bodies subjects of the Russian Federation, management bodies of territorial state non-budgetary funds, municipal bodies, determined in accordance with the Budget Code of the Russian Federation, the most significant institutions of science, education, culture and healthcare (including, respectively, territorial bodies, state institutions subordinate to them), the State Atomic Energy Corporation " Rosatom, the State Corporation for Space Activities Roskosmos and their subordinate organizations in accordance with the rules for determining standard costs, approved respectively by the Government of the Russian Federation, the highest executive bodies of state power of the subjects of the Russian Federation, local administrations, are established taking into account the categories and (or) groups of positions of employees.

Requirements for certain types of goods, works, services purchased by subordinate organizations provided for in clause 2 of these General Rules are delimited by categories and (or) groups of positions of employees of these organizations according to the staffing table.

14. The price of a unit of goods, works, services planned for purchase cannot be higher than the marginal price of goods, works, services established in the departmental list.

15. The marginal prices of goods, works, services established by the Government of the Russian Federation, the highest executive bodies of state power of the constituent entities of the Russian Federation, local administrations, cannot exceed the marginal prices of goods, works, services established by these bodies when approving standard costs for ensuring the functions of state bodies , management bodies of state non-budgetary funds of the Russian Federation, state bodies of the constituent entities of the Russian Federation, management bodies of territorial state non-budgetary funds, municipal bodies, determined in accordance with the Budget Code of the Russian Federation, the most significant institutions of science, education, culture and healthcare (including, respectively, territorial bodies subordinated to state institutions), the State Corporation for Atomic Energy "Rosatom", the State Corporation for Space Activities "Roskosmos" and subordinated to them organizations.

16. Values ​​of characteristics (properties) of certain types of goods, works, services (including marginal prices of goods, works, services) included in the mandatory list contained in the rules for determining requirements and purchased for the managers of the State Atomic Energy Corporation "Rosatom" , the State Corporation for Space Activities "Roskosmos" and the most significant institutions of science, education, culture and healthcare determined in accordance with the Budget Code of the Russian Federation, cannot exceed (if an upper limit value is set) or be lower (if a lower limit value is set) values characteristics (properties) of the relevant individual types of goods, works, services (including the marginal prices of goods, works, services) established by the rules for determining requirements approved by the Government of the Russian Federation for a state civil servant replacing the position of head or deputy head of the federal agency, belonging to the highest group of civil service positions of the category "leaders".

Values ​​of characteristics (properties) of certain types of goods, works, services (including marginal prices of goods, works, services) included in the mandatory list contained in the rules for determining requirements and purchased for heads of federal state bodies whose positions do not belong to the categories positions of the state civil service, cannot exceed (if the upper limit value is set) or be lower (if the lower limit value is set) the values ​​of the characteristics (properties) of the relevant individual types of goods, works, services (including the marginal prices of goods, works, services) , established by the rules for determining requirements, approved by the Government of the Russian Federation, for a state civil servant replacing the position of the head or deputy head of a federal state body, relating to the highest group of civil service positions of the category "heads".

Values ​​of characteristics (properties) of certain types of goods, works, services (including marginal prices of goods, works, services) included in the mandatory list contained in the rules for determining requirements and purchased for state civil servants of state bodies of the constituent entities of the Russian Federation and municipal employees belonging to the category "heads", heads of management bodies of territorial state non-budgetary funds, heads of subordinate organizations provided for in paragraph 2 of these General Rules, cannot exceed (if the upper limit value is set) or be lower (if the lower limit value is set) the values ​​of the characteristics ( properties) of the relevant individual types of goods, works, services (including the marginal prices of goods, works, services) established by the rules for determining requirements approved by the Government of the Russian Federation for a public civil servant replacing the position of parent (deputy head) of a structural subdivision of a federal state body, belonging to the highest group of civil service positions of the category "heads".

The values ​​of the characteristics (properties) of certain types of goods, works, services (including the marginal prices of goods, works, services) included in the mandatory list contained in the rules for determining requirements and purchased for employees of federal state bodies not specified in paragraph two of this paragraph, whose positions do not belong to the categories of civil service positions, cannot exceed (if the upper limit value is set) or be lower (if the lower limit value is set) the values ​​of the characteristics (properties) of the relevant individual types of goods, works, services (including marginal prices of goods, works, services) established by the rules for determining requirements approved by the Government of the Russian Federation for a state civil servant holding a position in a federal state body belonging to the category "specialists".

The values ​​of the characteristics (properties) of certain types of goods, works, services (including the marginal prices of goods, works, services) included in the mandatory list contained in the rules for determining requirements and purchased for employees of state bodies of the constituent entities of the Russian Federation and municipal bodies are not specified in paragraph three of this paragraph, for employees of the management bodies of territorial state extra-budgetary funds who are not their heads, employees of organizations subordinate to them, provided for in paragraph 2 of these General Rules, who are not their heads, employees of the State Atomic Energy Corporation "Rosatom" and the State Corporation for space activities of Roskosmos, who are not their leaders, employees of the most significant institutions of science, education, culture and healthcare determined in accordance with the Budget Code of the Russian Federation, who are not their leaders, cannot exceed (if the upper limit value is set) or be lower (if the lower limit value is set) of the values ​​of the characteristics (properties) of the relevant individual types of goods, works, services (including the marginal prices of goods, works, services) established by the rules for determining requirements approved by the Government of the Russian Federation , for a state civil servant who fills a position in a federal state body belonging to the category "specialists".
