The implementation of the order requires a fairly long time to solve various organizational work from training all the leaders of the organization in specialized training centers on labor protection issues to the preparation and approval of training programs for various specialties.     In the work safety system in the organization, some kind of participation of all employees in terms of labor protection management at the enterprise has been introduced. This is one of the few cases when not only managers, but also ordinary workers' organizations are involved in solving production issues. We are talking about the creation of commissions and committees aimed at working in the field of security. In order for such a group to be created with the participation of the head of the organization and his subordinates, an order is issued to create a commission on labor protection. But this is only the beginning, giving the right to the emergence of a special group. And for its functioning, the nuances are specified in the local act - the Regulations on the committee (commission) for labor protection. Let us give a sample order on the creation of a commission and explain some of the features of its preparation.

    OSH committees (commissions)

    There are several goals for the emergence of such a commission:

    In the process of work, the labor protection committee relies on the Model Regulation approved by Order No. 412 of the Ministry of Labor of June 24, 2014. Based on it, each specific organization develops local Regulations on the committee or commission on labor protection

    In order to comply with the requirements of labor protection, to control their implementation, in each organization engaged in production activities with more than 50 employees, a labor protection service must be created (part 1 of article 217 of the Labor Code of the Russian Federation).

    If the number of personnel does not exceed the specified limit, the decision to create a service is made by the head of the organization (entrepreneur) at his own discretion.

    How a committee (commission) on labor protection is created

    If the initiative is shown, the enterprise starts to create this commission.

    For these purposes, the employer not only issues an order on the commission on labor protection, but also proposes to include his representatives in its composition (he has the right to such a decision). And representatives from the collective are selected either as a result of voting at a general meeting of workers, or they are proposed by the primary trade union organization, if the trade union includes at least 50% of the total number of employees at this enterprise.

    The number of persons included in the commission depends on several factors, in particular:

    • the total number of employees in the organization;
    • specifics of production;
    • the number of structural units.

    The commission consists of a chairman, each side nominates vice-chairmen. A secretary is also elected. The work of the commission is carried out according to a previously developed plan and regulations approved by the chairman.

    Both the creation of a labor protection commission and its subsequent work are stipulated in accordance with GOST R 12.0.007-2009 “Occupational Safety and Health System” (approved on April 21, 2009 by the publication of the Order of Rostekhregulirovanie No. 138-st).     All issued and saved orders for labor protection, including the order for the appointment of a labor protection commission, are governed by general rules developed for procedures of this kind. Orders are classified by direction: by personnel and by main activity.

    Is it necessary to issue certificates to those employees who have passed the fire-technical minimum in their organization?

    Order of the EMERCOM of Russia No. 645 dated 12/12/2007 “On Approval of the Fire Safety Standards “Training Fire Safety Measures for Employees of Organizations”” provides for training employees of the organization in the fire-technical minimum. But this document does not tell how to confirm that the employee has passed this training.

    Neither about the protocol, nor about the certificate according to the results testing knowledge in the scope of the fire-technical minimum in the Order of the Ministry of Emergency Situations No. 645 there is no question.

    It is generally accepted that the test of knowledge in any field ends with a protocol and the subsequent issuance of a certificate. But, I repeat, the Order of the Ministry of Emergency Situations No. 645 does not speak about this. Create a commission? Yes. Conduct a knowledge test? Yes. Submit test results? Unknown.

    At my enterprise, I introduced the procedure for issuing protocols. If there is a commission, then there must be a protocol. After the protocol is drawn up, a mark is made in the employee’s knowledge test certificate about passing the knowledge test in the scope of the fire-technical minimum. If the form of the protocol and certificates are not established, then they can be drawn up arbitrarily. This is what we use. Such an order will not contradict Order No. 645, but will only supplement it.

    But I am inclined to think that even if, when checking the organization, the fire inspector clings to the fact that the organization does not have trained fire-technical minimum, this can be easily refuted. You show the inspector:

    1. Order on the establishment of a commission to test knowledge in the scope of the fire-technical minimum;
    2. Certificates of members of the commission that they have passed the knowledge test with a break from work (in the training center);
    3. The actual training program for the fire-technical minimum (agreed with the State Fire Supervision Authority);
    4. Questionnaires.

    After that, with honest eyes, say that the fire-technical minimum has been carried out for the employees, but since the Order of the Ministry of Emergency Situations No. 645 does not define the procedure for completing the protocol and issuing certificates, there is nothing to issue to the employees. I think in this case the inspector will scratch the back of his head and cross out this violation.

    1. Rights of the fire and technical commission

    4.1. Prepares the management of the institution information on violations of fire safety requirements in certain areas of the institution, during the operation of buildings, structures and premises where there is an immediate threat of fire and death.

    4.2. Submits proposals to the management of the institution to hear the persons responsible for the fire safety of the facilities of the institution where the fire situation is unsatisfactory, as well as proposals to bring to disciplinary responsibility persons violating the fire regime.

    1. Organization of the work of the fire-technical commission

    5.1. Based on the results of the inspection of the fire-prevention state of the institution, the PTK draws up an act (appendix) in which it establishes the deadlines for the implementation of measures and responsible executors.

    5.2. The act is signed by the chairman and members of the PTK and approved by the director of the institution.

    5.3. The measures provided for by the act are subject to implementation within the established time limits.

    5.4. The meeting of the PTC is held quarterly and is documented in minutes.

    Why is this step one of the first? Coordination of special programs is carried out by structural subdivisions of the relevant territorial bodies of the EMERCOM of Russia - territorial departments of supervisory activities (hereinafter - TOND).     What documents are issued by the commission after passing the knowledge test in the field of fire safety?

    If the employees of the organization have successfully passed the test, they are given a special certificate and a warning card. This addition is mandatory and in case of detection of violations of fire safety due to the fault of the employee, the coupon is withdrawn. If the guilty citizens again repeatedly violate the norms and rules of fire safety, then administrative or disciplinary penalties, up to and including dismissal, may be applied to them.
