Periodic medical examinations for employees of some enterprises are mandatory. In everyday life, such examinations are often called medical examinations or professional examinations. The list of employees subject to mandatory professional examinations is drawn up in a special document - a list. Which employees should be included in it, how to draw it up correctly and where to send it?

Legislative framework

The purpose of mandatory periodic medical examinations in accordance with Art. 213 TC are:

  1. Determining the suitability of employees to perform work duties and to prevent occupational diseases. These goals of professional examinations are established for employees whose work is associated with dangerous or harmful working conditions.
  2. Public health protection is relevant for employees of organizations whose activities are related to the population.

The procedure for medical examinations is regulated by the Federal Law of November 21, 2011 No. 323-FZ and the Order of the Ministry of Health and Social Development of Russia of April 12, 2011 No. 302n. The Order establishes a list of professions subject to periodic medical examinations, and harmful production factors, in the presence of which professional examinations are mandatory. It also states:

  • the frequency of passage and the order of their conduct;
  • a list of specialist doctors who need to undergo a medical examination;
  • a list of laboratory and other studies as part of a medical examination;
  • a list of medical contraindications for this type of profession or for those working in conditions of specific harmful factors.

It should be borne in mind that medical examinations of employees specified in Order No. 302n are carried out at the expense of the employer's own funds in accordance with Art. 212 of the Labor Code of the Russian Federation. During the period the employee undergoes a mandatory medical examination, he retains the average earnings in accordance with Art. 185 of the Labor Code of the Russian Federation.

Step-by-step algorithm for organizing and conducting a medical examination

The procedure for organizing mandatory periodic medical examinations is standard and includes the following steps:

  1. An official of the organization (usually a personnel officer) prepares a list of contingents subject to periodic medical examinations.
  2. The organization enters into an agreement with a licensed medical institution for mandatory medical examinations.
  3. The personnel officer (or labor protection specialist) draws up a list of names of persons subject to mandatory periodic medical examinations.
  4. The medical institution develops a calendar plan for conducting professional examinations and coordinates it with the employing organization.
  5. The employer acquaints employees with the calendar plan for the medical examination. Most often this happens by issuing an order to send for medical examination with an indication of the period of its passage.
  6. Each employee on the list receives a referral for inspection.
  7. Each employee, within the period specified in the Order, submits to the employer the result of the medical examination and the final act on the results of the medical examination obtained in the medical institution.

An important stage is the preparation of lists

Let us consider in more detail the actions of the employer in relation to the first step of the procedure, namely, how, in accordance with the requirements of Order No. 302n, a contingent of employees subject to periodic medical examinations is formed.

In the list of the contingent, be sure to indicate:

  1. The name of the profession (position) of the employee listed in Appendix No. 2 to Order No. 302n.
  2. The name of the harmful production factor, in accordance with Appendix No. 1 to Order No. 302n. Harmful factors can be established in accordance with paragraph 20 of the Order on the basis of:
  • results of attestation or special assessment of workplaces in terms of working conditions;
  • laboratory studies and tests obtained as part of control and supervision activities, production laboratory control;
  • operational, technological and other documentation for machines, mechanisms, equipment, raw materials and materials used by the employer in the implementation of production activities.

The unified form of the list of contingent of persons for medical examination is not established by law. We offer you a sample of the contingent of persons subject to periodic medical examinations.

The contingent list approved by the head is sent within 10 days to the local branch of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare (Rospotrebnadzor) (clause 21 of Order 302n).

The first step in organizing the procedure for mandatory periodic medical examinations is very important. If the employer has not determined the contingent of persons subject to periodic medical examination, and the lists have not been provided to the Rospotrebnadzor authorities, the organization may be held liable under Art. 6.3 of the Code of Administrative Offenses of the Russian Federation for violation of the legislation in the field of ensuring the sanitary and epidemiological welfare of the population. This circumstance is also confirmed by judicial practice (in case No. A60-47002/2013).

Preliminary and periodic medical examinations are one of the most important measures aimed at preserving the life and health of employees in the course of their work. Their goal is to establish the suitability of a person for the work performed, or the conditions in which they will have to work, to carry out the prevention of occupational diseases in a timely manner and to prevent accidents.

Attention! Responsibility for organizing and financing mandatory medical examinations lies with the employer, who, in case of failure to comply with the established procedure, may be held administratively liable.

In accordance with Article 213 of the Labor Code of the Russian Federation, workers engaged in hard work and work with harmful and (or) dangerous working conditions(including underground works, as well as work related to traffic), undergo mandatory preliminary (when applying for a job) and periodic medical examinations.

Another category of persons undergoing a mandatory preliminary examination are workers in the food industry, public catering trade, water supply facilities, medical organizations and children's institutions.

A medical examination is an event regulated by law, associated with the execution of mandatory documentation.

One of the documents that should be developed in preparation for medical examinations is list of contingent of workers subject to preliminary and periodic medical examination. This is a local regulatory act of the organization, which contains information about the professions (positions) of employees who are required to undergo medical examinations.

Its form is not approved by law, clause 20 of the Order dated 12.04.2011 N 302n “On approval of lists of harmful and (or) hazardous production factors and work, during the performance of which mandatory preliminary and periodic medical examinations (examinations) are carried out ...” (hereinafter Order No. 302n) stipulates only what mandatory data is indicated in it.

And so, in the contingent of workers subject to preliminary and periodic medical examinations, the following are indicated:

1. the name of the profession (position) of the employee according to the staffing table.

Important! Employees under the age of 21 undergo periodic examinations annually. Therefore, if you have positions/professions in which persons under the age of 21 are employed, also do not forget to include them in the list.

In addition to the mandatory information provided for by Order No. 302n, you can include other information (name of the unit, number of employees in the organization, number of employees employed in jobs with harmful working conditions). The appendix contains several forms of the list of the contingent of persons subject to preliminary and periodic medical examination.

The list of contingents is developed and approved once, before any changes in the organization (reorganization, commissioning of new jobs, improvement of working conditions). Name lists based on the contingent will be developed annually.

Since 01/01/2012, the procedure for coordinating contingents and name lists with the bodies of Rospotrebnadzor is not provided, while the employer is obliged, within 10 days from the date of approval of the list of contingents, to send it to the territorial body of the federal executive body authorized to implement the federal state sanitary- epidemiological surveillance at the actual location of the employer. Thus, you can personally transfer the list of contingents to Rospotrebnadzor, while on your copy the representative of Rospotrebnadzor must mark that he received one copy, or send it by registered mail. In this case, the letter is sent with a notification, and the notification is kept by you as confirmation that the requirements of Order No. 302n have been met by you.

The list of names of the contingent according to Order 302n, the sample is attached, is formed in order to undergo a medical examination of employees subject to periodic examination. The main purpose of such events is, first of all, to assess the state of human health in order to prevent accidents at work; determination of suitability for working conditions and, if necessary, prevention of the occurrence of diseases. Let's consider how the specified list is compiled and what should be the sample referral for a medical examination according to Order 302n.

The document refers to the internal forms of the organization and is drawn up in an arbitrary form, taking into account the norms provided for by law. The following categories of persons are subject to inclusion in the contingent for medical examinations:

Important! After January 1, 2014, the certification of workplaces was replaced by special. assessment of working conditions (SAUT), but the normative wording has so far remained the same.

  • The document is drawn up in the amount of 3 copies, each of which is approved by the signature of the director and the seal of the enterprise.
  • Prior to the start of the medical examination, the list, together with a cover letter and a list of names, is submitted to the territorial body of Rospotrebnadzor. To expedite the process, it is best to submit the form in person.
  • It is obligatory to reflect information regarding: the name of production, workshops and sites; a list of all positions according to the staffing table; total number of employees, incl. women; hazardous work; numbering; frequency of medical examinations.
  • There must be a header containing the visa "Approve" and the name of the department of Rospotrebnadzor.
  • At the bottom, the page is closed with a transcript and signature of the head, seal.

Note! Part-time employees and employees under the age of 21 are also subject to medical examinations (such persons must undergo examinations annually).

The contingent list is formed and approved once, if there are no changes in the organization. For example, this is an improvement in the conditions for workers, the reorganization of an enterprise, the commissioning of new places of work. The name list is subject to annual compilation. After January 1, 2012, the coordination of these documents with Rospotrebnadzor was canceled, but the notification procedure continues to operate. It is necessary to report on the generated lists within 10 days from the date of approval.

Important! The employer is obliged to ensure the storage of standard documents for medical examinations for 3 years in accordance with the legislative storage periods.

Form for a medical examination by Order 302n

Medical examinations are carried out both when applying for a job, and by already working individuals with a certain frequency. The basis for participation in the examination and filling out the conclusion based on the results is the referral for a medical examination according to Order 302n, the example form is located below. Filling out the document is carried out by the responsible person of the employer. The form can be developed independently, but the following data must be indicated:

  1. Name of the enterprise, its legal form, address, type of activity; name of honey institutions, OGRN, address.
  2. Full name and date of birth of the examined employees.
  3. Status (already working, newly arriving).
  4. Shop and area.
  5. Type of work, position.
  6. Length of service in the specified position.
  7. Previous experience and types of work.
  8. Hazardous factors according to the List of factors/works.

The form must be signed by the employer and sealed with the seal of the organization. According to the legislative requirements, from the moment the relevant referrals are received, the employee is recognized as responsible for passing the inspection (Article 214 of the Labor Code). At the end of the procedure, the employee brings all the documents to the employer, who organizes the storage of personal data in accordance with archival standards.

What is the problem

The obligation to organize and conduct medical examinations and research is assigned to employers. Moreover, for certain categories of workers (the so-called contingent of persons), medical examinations are mandatory.

There are three types of medical examinations: preliminary (when applying for a job), periodic (systematically, several times throughout the entire working life), extraordinary (according to individual indications).

A complete list of professions subject to periodic medical examinations is established as mandatory by the Federal Law of November 21, 2011 No. 323 and specified in the Order of the Ministry of Health and Social Development of the Russian Federation of April 12, 2011 No. 302n, namely: officials provide a list of harmful labor factors, as well as a list of hazardous work, where a medical examination is mandatory.

  • employees of educational and children's organizations;
  • catering representatives;

  • employed in poultry farms, in animal husbandry, cattle breeding, etc.

This list is not closed, that is, the employer has the right to establish mandatory examinations for other positions and professions (accountant, driver, cleaners ...).

How to organize a medical examination at the enterprise

The general procedure for organizing medical examinations is enshrined in Appendix No. 3 to Order 302n. Here is the step by step algorithm:

  1. The Company approves the list of contingents subject to periodic medical examinations (a sample document is presented below). For each profession, harmful factors should be indicated (according to the results of a special assessment). This list must be submitted to Rospotrebnadzor.
  2. Then the management of the enterprise chooses a licensed medical institution that has the right to provide such services. A contract for the provision of services is concluded.
  3. Now a list of names of persons subject to periodic medical examinations is sent to a specialized medical facility.
  4. The calendar plan for medical examinations is compiled by the medical institution and agreed with the company's management.
  5. The administration of the organization acquaints its employees with the calendar plan and issues directions for passing a medical examination (examination).
  6. The medical institution conducts a medical examination for each employee, according to the contingent of employees subject to periodic medical examinations. The medical report is drawn up individually for each of the employees of the company. The medical institution also prepares a general final act on the examinations carried out.
  7. The employee submits an individual medical report to the employer's administration to make a decision on suitability for the position.

What are the penalties for violating

The list of employees for mandatory medical examinations must be compiled at the enterprise and submitted to Rospotrebnadzor. If this is not done, then the following fines may be issued for violation of the law on this topic:

  • for officials - from 500 to 1000 rubles;
  • for individual entrepreneurs - from 500 to 1000 rubles or an administrative suspension of activities for up to 90 days;
  • for legal entities - from 10,000 to 20,000 rubles or an administrative suspension of activities for up to 90 days.

Who must pass

  5. Water workers.
  6. Workers performing work at height.

Extraordinary medical examination should be carried out at the personal request of employees of the enterprise, after finding occupational diseases, in case of a life-threatening infection that can spread in the team, and at the request of Rospotrebnadzor.

Algorithm for organizing and conducting

Management is responsible for organizing and conducting medical examinations at the enterprise. It should pay for a medical examination for their employees.

Consider step by step algorithm medical examination:

  1. Create a list of employees who must undergo a medical examination.
  2. Submit the list to the Department of Consumer Protection.
  3. Conclude an agreement with the medical center on the examination.
  4. Familiarize employees with the order to undergo a medical examination.
  5. Issue referrals to employees.
  6. Collect documents with the results of this procedure. (The conclusion must be in two copies, since one is given to the employee, and the second remains in the medical center).

The list of the contingent must be submitted in three copies. In the header of the document, you must indicate the name of the department of Raspotrebnadzor, on the right - the data of the head of the company. According to the Order of the Ministry of Health of Russia, the document must indicate:

  • the name of the enterprise, firm, shop;
  • types of professions;
  • the number of workers in production;
  • unsafe and harmful factors and conditions;
  • frequency of inspections.

List of harmful factors

Exists 4 groups harmful production factors, in the presence of which employees of the enterprise must undergo a mandatory periodic medical examination:

  1. Chemical(negative substances that can harm workers).
  2. Biological(drugs, biological toxins, allergens, dust of various origins).
  3. Physical(various radiation, electromagnetic fields).
  4. Factors of labor production(physical reboots).

The cost of passing the medical examination is borne by the head. Approximate cost per employee is from 2000 to 5000 rubles.

The cost itself depends on the number of doctors that the worker must undergo and laboratory tests. Most often, the more employees go for inspection, the less the manager pays for it.

Most medical centers provide discounts depending on the number of employees. In Russia, the state compensates the manager for lost funds through the insurance fund.

Accounting for medical examination at the enterprise

In order to properly prepare documents for passing a medical examination of each employee, it is necessary to periodically update information about your workers.

The labor protection service leads flow control for medical examination of employees of the enterprise. Copies of the following documents must be available:

  1. List of employees who undergo periodic medical examinations.
  2. Conclusion of acts of preliminary reviews
  3. Certificates of passing narcologists, psychologists, etc.
  4. Current information about the health status of each employee.

Company employee card

The employee's card usually indicates complaints about health problems, all the conclusions of the results of previous medical examinations, documents on suitability.

The document contains confidential information, so it must be in an inaccessible place. Most often, employee cards are kept by the health worker of the enterprise or in the personnel department.

In cases of dismissal, change of place of work, the card is given to the employee personally against signature, but a copy must remain at the enterprise.

A medical card is issued only in case of passing a medical examination, after which it is given to the head.

Responsibility of management and employee

A manager who allows employees who have not passed a medical examination to work may incur big losses. In this case, he violates the law and must be held accountable.

For these illegal actions, the entrepreneur will have to pay a fine. But the punishment will not bypass the worker. He, too, will have to pay a fine and may be fired from his job.

Best case scenario the employee will be suspended from work and will not be able to receive wages until they pass a medical examination.

For reasons independent of the employee of a failed medical examination, he continues to work, but receives 2/3 of his salary.

The frequency of periodic medical examination depends only on the profession, the complexity of the work performed and the type of activity. The responsible manager must undergo and conduct a medical examination annually, introducing new additional examinations to improve the condition of employees.
