The commission on labor protection can be created at the enterprise at the initiative of any of the parties: the employer, at the initiative of employees or at the initiative of the representative body of employees. The goal is to coordinate actions, the interaction of the employer and employees to ensure the requirements of labor protection, the prevention of traumatic situations and the occurrence of occupational diseases. The main functions of the commission on labor protection are contained in the Standard Regulations approved by order of the Ministry of Labor of Russia dated June 24, 2014 No. 412n:

  • assistance to the employer in organizing training in the safe performance of work, analysis of the causes of injuries, development of measures to eliminate negative aspects;
  • providing employees with up-to-date information on ongoing measures aimed at improving working conditions, reducing injuries in the performance of work duties, preventing the occurrence of occupational diseases;
  • development of recommendations that can improve working conditions;
  • participation in inspections of the state of conditions and labor protection, assistance to the labor protection service in the introduction of more modern and safer production technologies, new equipment, participation in discussions of the financial side of these issues, etc.

The commission consists of representatives of the employer and employees (trade union of employees). The number of participants in the commission is not defined: depending on the number of employees of the enterprise, it can be more or less. The parties nominate their representatives to the commission, and the final composition of the commission is approved by the order of the employer. The committee appoints a chairman from among its members.

Minutes of the meeting of the commission on labor protection (sample)

The procedure according to which the work of the commission is carried out is determined by a local regulatory act - for example, the regulation on the commission on labor protection. This document is approved by the order of the employer, taking into account the opinion of the trade union organization of workers.

The commission develops regulations and a work plan, which are approved by the chairman of the commission. Based on the results of each meeting of the committee, a protocol of the meeting of the commission on labor protection is drawn up.

In what order should the protocol be completed? In the header of the protocol, it is worth writing the name of the company, the name of the event “Minutes of the meeting of the commission on labor protection”, the name of the document - “Minutes”, as well as the number of the protocol, the date of filling.

    What is this document?

    Checking the knowledge of all employees is a very important event at the enterprise, therefore it is subject to mandatory recording.

    The protocol of such a meeting reflects the principle of collegiality of the meeting and refers to administrative documentation with a priority legal function.

    Protocol for testing the knowledge (requirements) of labor protection of employees (hereinafter referred to as the Protocol) is a document that records the results of passing exams on a list of persons who have undergone compulsory training.

    In what cases is it required?

    The protocol is inextricably linked with the commission for checking the requirements of labor protection of the organization, it is this board of qualified specialists that publishes it at its meeting.

    But above all, the members of the commission themselves must be trained in a specialized educational institution.

    So, it turns out:

    • The first case of the requirement of the Protocol: members of the OT requirements verification commission are certified at the training center and receive a copy of the protocol, which records the results of the verification, along with their certificate.
    • The second case of the requirement of the Protocol: by order of the head, a commission is created to verify the requirements of OT, it includes at least three people who have already completed their training and certification and have a certificate in their hands.     Thus, a three-level control over the knowledge and skills of managers, specialists and workers in safety is implemented.

    Reasons for compiling

    The normative justification for drawing up the protocol is enshrined in the Procedure for training on labor protection and testing knowledge of the labor protection requirements of employees of the organization, approved by the Decree of the Ministry of Labor of Russia and the Ministry of Education of Russia dated January 13, 2003 No. 1/29.

    It is in this Decree that the main actions to be carried out by managers, services, committees on labor issues of workers, its safety and security, as well as the procedure for training and testing knowledge of OT, are spelled out in detail.

    Section III is entirely devoted to certification activities in this area, who and when they should conduct them, how often and what the employee receives as a result of the audit. Paragraph 3.6 states that these results are documented using a protocol.

    How to draw up a protocol for testing knowledge on labor protection?

    Document Requirements

    It is extremely important to draw up the Protocol correctly when it comes to ensuring the legal force of the decision taken by the collegiate meeting.

    Therefore, it has a number of requirements:

    • brevity. In this case, it is allowed to use an abbreviated form of logging according to the scheme: “employee name - decision made”. That is, the document lists the names of the members of the commission, indicates the main topic and the basis for its compilation, and according to the list of employees, there is a list of the commission's decisions: "passed - did not pass."
    • Depending on the number of employees, the Protocol can turn out to be multi-page. However, the requirements for the design of its first page remain unchanged: it must be printed either on the letterhead of the enterprise (if any), or according to its sample or in the usual longitudinal way with a central location of inscriptions.
    • Day-to-day compilation. This means that the meeting of the commission at which the Protocol is drawn up takes place on the same date as the date of the order to conduct a scheduled examination of the knowledge of employees in the field of labor protection.

    Form and Sections

    Like other administrative documents, the Protocol form is prepared in electronic form and printed on A4 sheets.

    Its mandatory sections are:

    • full name of the enterprise;
    • header (PROTOCOL);
    • date of the meeting;
    • composition of the commission: chairman, members;
    • the basis for compiling (this is the number and date of the order on the creation of a permanent commission to test knowledge of the requirements of OT);
    • text: the topic of the training program, the number of hours, a list of employees with signatures in the introduction;
    • signatures of committee members.

    1. The name of the organization must be indicated in full along with the type of legal form (not “LLC”, but “Limited Liability Company”).
    2. In the case of the work of the commission of a separate workshop, a note is made below about its name.
    3. The title "PROTOCOL" is written in capital letters, slightly below the names, but always in the center.
    4. The date format is alphanumeric. It is this method that is provided for the protocols of collegiate bodies.
    5. Signatures of all parties: members of the commission and certified employees are already affixed to the edited copy of the Protocol.
    6. Signatures do not need to be stamped as this document is an internal document.

    Nuances

    When is it filled?

    Before the meeting, the secretary of the commission prepares lists of employees sent for verification and several blank forms of the Protocol itself. The copy that the secretary fills out directly at the meeting itself is a draft version.

    At the end of the verification meeting, the secretary needs to bring his notes together and draw up the final version of the Protocol. It is in this document that employees will sign when they get acquainted with the results of testing their knowledge.

    How many copies do you need?

    The protocol is drawn up in two copies: both of them must contain all the necessary details and signatures of employees.

    Is registration required?

    Next to the word "PROTOCOL" its number (index) should always be present. This is required by the business rules.

    Meanwhile, registration of protocols in special log books is always required. The correct design of the protocol index is a two-digit designation, for example, not 1, but 01.

    Where to store?

    One original of the Protocol remains with the labor protection engineer, the other is sent to the personnel department - that's why it is drawn up in two copies.

    Responsibility of the employer for errors in the preparation

    The employer is responsible for the correct organization of training, knowledge testing, briefings, therefore, errors in such significant administrative documents as the Protocol are not allowed.

    Possible violations can be identified during the investigation of accidents at work.

    All documents on labor protection that were maintained at the enterprise will be checked, training programs and protocols of verification activities will be thoroughly studied. In case of violations in the preparation of documentation or the absence of signatures of those instructed upon passing the OT exam, the fault lies entirely with the employer.
